In a recent ruling, two brothers serving in the Uganda Peoples’ Defence Forces (UPDF) have been convicted of the murder of Evelyn Nantale, a mobile money agent. The General Court Martial, chaired by Brig. Gen. Freeman Robert Mugabe, found Private Julius Kisuule and Private David Kisuule guilty of the crime committed at Kamwamu Zone in Kiyindi town council, Buikwe district.
The conviction came after the prosecution, led by Capt. Ambrose Guma and Capt. Alex Mukhwana, presented compelling evidence from five witnesses. Brig. Gen. Mugabe stated, “This court, after evaluating the evidence on record, is satisfied that the prosecution proved each of the ingredients of the offence of murder against the accused persons. I hereby find each of the accused guilty of murder, contrary to Section 188 and 189 of the Penal Code Act as charged.”
The court postponed the sentencing to August 12, as the defense, represented by lawyer Emmanuel Turyomwe, was not prepared for the mitigation phase. The maximum penalty for murder under Ugandan law is death.
The case against the Kisuule brothers was bolstered by witness testimonies and evidence of malice aforethought.
Notably, the disappearance of David from the crime scene immediately after the incident was deemed indicative of guilt. The court also dismissed David’s alibi, which claimed he was at home during the time of the murder, finding it inconsistent with other evidence.
Assistant Superintendent of Police Afsa Ninkunda and Police officer Abdala Kabonge provided key testimony. Ninkunda recounted arriving at the crime scene on January 9, 2020, after hearing gunshots, where she found a mob attacking Julius Kisuule, who was later rescued by the police.
Julius confessed to the murder while at the hospital, and Ninkunda corroborated the events leading to Nantale’s death. Kabonge detailed discovering Nantale’s body and the subsequent arrest of Julius.
