High Court Upholds Cavendish University’s Dismissal of Lecturer Over Dual Employment

The High Court has upheld Cavendish University’s decision to dismiss Dr. Fredrick Kiwuwa Lugya after finding that he held two full-time academic positions at Cavendish University and Makerere University without proper disclosure which is against the law.

In his judgment, Justice Musana agreed with the university’s position, ruling that Dr. Lugya could not maintain two full-time jobs while failing to comply with his contractual obligations.

Justice Musana observed that Dr. Lugya could not “have his cake and eat it too” by serving in two full-time roles at different institutions without transparency.

The court found that Cavendish University acted within its legal rights when it terminated his employment, noting that the institution’s policies prohibit undisclosed moonlighting by full-time employees.

According to the ruling, the dismissal was consistent with the terms of Dr. Lugya’s employment contract and the university’s internal regulations.

Dr. Lugya, a Library and Information Science professional, has previously served in academic positions at Makerere University and Busitema University.

Legal observers say the judgment reinforces the importance of honesty, transparency, and compliance with employment contracts within Uganda’s higher education sector, particularly for full-time academic staff.

The ruling is expected to serve as a reference point for universities and other institutions dealing with similar cases involving dual employment and contractual obligations.
